Fakir Groups MD files Tk500cr defamation suit against singer Eva Arman

Fakir Group Managing Director Fakir Aktaruzzaman has filed a defamation case of Tk500 crore against singer Sheikh Urmi Arman Eva over "publically lying about not having sold them any property."

The group's legal adviser Advocate Zafar Sharif told the media that the case was filed very recently in Dhaka's Fifth Joint District Judge Court.

According to the case documents, the company's Deputy Managing Director Fakir Masrikuzzaman and Director Fakir Masfikuzzaman signed an agreement with Disney Properties Limited for the purchase of two apartments in a multi-storeyed residential building named "Evaroz" in Gulshan 2 on 28 March 2016.

Sheikh Urmi Arman Eva, having received the land from her ex-husband ATN Bangla Chairman Mahfuzur Rahman, signed an agreement with Disney Properties Limited to construct the building and gave the registry to the company on 18 February 2010.

Later, Eva took responsibility for the construction of the building following a reported dispute with the developer.

Fakir Masfikuzzaman and Fakir Masrikuzzaman signed a registered sale agreement with Eva for two flats in December 2017.

The agreement stipulated that Eva would complete the building and register the flats within six months, with buyers paying in full upfront. Eva was also obligated to transfer ownership via a Saf Kabla deed.

However, the two flats were transferred to the buyers in an incomplete condition.

Additionally, Eva reportedly altered the approved building design, disregarding Rajuk regulations, and proceeded to construct and rent out shops.

Fakir Group Legal Adviser Zafar Sharif stated that Eva also refused to comply with the terms of the registered sale deed.

"Rather, she has been lying [to the media] that she did not sell those two flats," he said.

He said later Eva filed a civil case in the First Joint District Judge's Court regarding those two flats. The court had ordered both parties to maintain the status quo and the case is currently ongoing.

Eva then filed a petition against Fakir Aktaruzzaman in the Executive Magistrate's Court, alleging a breach of peace and order concerning the two flats. The court, however, dismissed the matter.
